Dear Mr. Goodlin:
Your letter of 10 October 1984, directed to Mr. Stanford N.
McDonnell, President of McDonnell Douglas, has been referred for
response to our Corporate Patent Department since you make
reference to "Burnelli Patent and/or proprietary rights."
This will advise that all work by the McDonnell Douglas
Corporation towards the development of a STOL F-15 has been
accomplished under a contract with the U. S. Department of Defense
and more particularly the U. S. Air Force. That contract for a
STOL Demonstration Program contains an Authorization and Consent
Clause which transfers any liability MDC may have relative to
Patents to the U. S. Government. Accordingly, your recourse in
this matter would be against the indicated Government Agency and,
if dissatisfied with the Agency findings, in an action in the
U. S. Court of Claims.
The referred to contract also contains a Notice and Assistance
Clause and, in accordance therewith, we are advising the
Government of your concerns.
