Dear Mr. Goodlin:
Your letter to the Office of the Associate General Counsel, (Intellectual Property) dated August 10, 1995, has been referred to me for response. In that letter you
stated that you desired to negotiate a license agreement for the use of Burnelli rights in a
lifting body jet-powered vehicle that was patented by Mr. Vincent J. Burnelli on February 19,
1952. NASA cannot consider a patent license for this invention because the patent grant for the
patent, United States Patent Number 2,586,299, expired on February 19, 1969.
This office of NASA does consider patent licenses in issued, unexpired United States patents;
however, once the 17 year term for a utility patent has expired, the patent owner has no patented
interest to license. Unfortunately, this is the case for your invention.
